Policy on Ownership of Course Materials

Enclosed is the new Policy on Ownership of Course Materials. This Policy is effective immediately.

This Policy was developed by the UC Standing Committee on Copyright (http://www.ucop.edu/copyright/) in consultation with the campuses and the Academic Senate. It is intended to supplement the existing Policy on Copyright Ownership (http://www.ucop.edu/ucophome/coordrev/policy/8-19-92.html) which remains in effect, addressing copyright ownership issues related to materials prepared for instructional purposes at the University of California.

The University's goal in preparing this policy was to clarify existing policy concepts and extend their application to works prepared for teaching and, in particular, to provide useful guidance for faculty, staff and administrators about intellectual property rights for teaching materials in digital form. Because the use of technology in instruction is a rapidly evolving area, the Policy provides that the Standing Committee on Copyright will monitor its implementation and recommend revisions based on experience. For the same reason, the Policy affords Chancellors flexibility in developing local implementing procedures, but in view of the central importance of these issues to the faculty, I urge you to work closely with your Academic Senate leadership to identify suitable mechanisms for Senate participation. In particular, any campus committees identified in a local procedure should include a preponderance of Academic Senate nominees.
