Adjustments
If you choose to have your inventions administered under the Old Policy, an adjustment may need to be made to your account in order to back-date the calculation of royalties to October 1, 1997. The adjustment may be positive or negative. If your choice results in a positive adjustment, a check will be issued to you. In order to help you make a decision we will provide you with the exact amount that your adjustment will be if you choose the Old Policy. Those inventors who are being given the oppportunity to choose between policies will receive details of their adjustment in a letter. While the adjustment is an important factor in your decision, there are several complex issues involved. We have provided a list of items for consideration in order to help you make your decision.
With regard to your adjustment, it should be noted that a positive adjustment figure does not imply that you will be better off under the Old Policy. It is true that an invention administered under the Old Policy will normally result in a greater cumulative payment to you as an inventor over the life of the invention, but this will not necessarily be the case in any given year. For any year in which unreimbursed expenses exceed more than half of income, an inventor will receive a higher payment under the Current Policy. While we cannot tell you definitively under which policy you will be better off, we have provided examples of calculation scenarios.
