LABOR AND EMPLOYMENT LAW ATTORNEY

The General Counsel of the University of California seeks a labor and employment law attorney in the Office of the General Counsel in Oakland, California. Must possess a J.D. from an accredited law school, have a minimum of eight years’ experience after receiving law degree, and be a member in good standing of the California Bar. The position requires demonstrated writing, analytical, communication, negotiation and client counseling skills; an in-depth knowledge of relevant federal and state employment/labor laws, regulations and case law, including, for example: HEERA, NLRA, FEHA, ADA, ADEA, FMLA, CFRA, FLSA, privacy, 1st Amendment and whistleblower issues, etc. and experience to conduct hearings and to work flexibly in a fast-paced, complex higher education environment. Candidates should have strong interpersonal skills and be able to work collaboratively with peers and clients. NLRB or PERB experience, as well as experience with public sector clients, strongly preferred. Salary is commensurate with qualifications and experience. The University provides an excellent benefits package, including a variety of tax-deferred annuity programs.

Responsibilities will include: providing legal advice to Labor Relations, Human Resources and administrators in connection with a wide range of labor and employment law matters, particularly focusing on preventative counseling, at the ten campuses, five medical centers and at other locations throughout California; defending the University before the Public Employment Relations Board (PERB) in labor relations matters and providing collective bargaining advice; representing the University in academic and staff grievance hearings and hearings before administrative agencies; drafting and providing advice for employment policies; and supervising outside counsel.

Starting salary range: $123,800 - $155,600. The University provides an excellent benefits package.

BENEFITS ATTORNEY

The General Counsel of the University of California seeks a benefits attorney to fill a position in the Office of the General Counsel in Oakland, California. Candidate must possess a J.D. from an accredited law school, have a minimum of eight years’ experience after receiving law degree in advising on benefits matters (defined benefit plan, defined contribution plans, health and welfare plans, legislation, and strategic planning), be a member in good standing of the California Bar, and possess demonstrated writing, analytical, communication and client counseling skills. Experience with public sector clients and health and welfare law preferred.

The successful candidate will share responsibilities with the existing benefits attorney on the following matters: UC’s defined benefit plan with 193,329 members; three defined contribution plans; a broad range of health and welfare plans overseen by in-house staff maintained for UC’s 150,000 employees; legislative changes affecting benefit plans; and strategic planning.

The governance of UC is shared by the 26-member Board of Regents, the UC President and the faculty. Benefits counsel provide legal advice in a fast-paced, complex academic/research environment that requires the ability to work quickly and collaboratively with diverse groups.

BUSINESS TRANSACTIONS ATTORNEY

The General Counsel of the University of California seeks an attorney for the Office of the General Counsel in Oakland, California in the specialty areas of business transactions, including the formation of non-profit entities, the receipt of gifts and the negotiation of gift agreements. Candidates must possess a J.D. from an accredited law school, have a minimum of eight years’ experience after receiving law degree, and be a member in good standing of the California Bar. The position requires demonstrated writing, analytical, communication, negotiation and client counseling skills; and a demonstrated ability to work flexibly in a fast-paced complex public sector, higher education environment. Candidates should have exceptionally strong interpersonal skills and must be able to work collaboratively with peers and clients.

Responsibilities:

  • Provide legal advice and representation in the systemwide management and operation of the University of California, its campuses, support groups, foundations, and alumni associations, as nonprofit higher-education charitable entities with regard to all facets of charitable fundraising and planned giving, including management and investment of charitable gift funds
  • Keep senior management informed of changes required by law, provide advice to clients involved in the administration of the University as a nonprofit higher-education charitable entity and help develop long-range strategies to achieve best practice within applicable laws and regulatory guidance
  • Provide legal services to the University of California, campuses, support groups, foundations, and alumni associations in connection with the structuring of transactions involving complex outright gifts; charitable remainder and charitable lead trusts; gift annuities; pooled income funds; other split-interest gifts; real estate gifts involving retained life estates; bequests; international transactions; and other transactions involving complex tax issues

Requirements:

  • J.D. with excellent academic credentials
  • Minimum of eight years relevant experience
  • CA Bar
  • Comprehensive working knowledge of relevant federal and state laws, regulations and case law, including California Constitution
  • Outstanding verbal and written communication skills
  • Proven negotiation skills
  • Strategic thinker with focus on practical client advice
  • Hardworking team player with ability to manage numerous projects simultaneously under deadline pressure
  • Experience representing public sector clients preferred

EDUCATIONAL AFFAIRS ATTORNEY

The General Counsel of the University of California seeks an attorney to fill a position in the Office of the General Counsel in Oakland, California. The attorney will work in the Educational Affairs and Campus Services section of the General Counsel’s office, focusing on a wide range of matters, including faculty personnel issues, academic freedom, student affairs, legislation affecting academic matters, Proposition 209, UC’s constitutional autonomy, and assistance to campus-based attorneys, with a goal of assuring consistent, excellent, and timely advice to campus and Oakland-based clients.
