As a federal contractor, UC is required to E-Verify the work status of (a) new hires assigned to a covered federal contract/subcontract and (b) existing employees hired after November 6, 1986 who are assigned to a covered federal contract/subcontract (including employees who may be assigned to such a contract/subcontract as the result of a transfer), unless one of several very narrow exceptions applies to a particular employee. Because it is an institution of higher education, the University is not required to E-Verify the work status for all new hires; rather, it is only required to do so for new hires assigned to a covered federal contract/subcontract.
The E-Verify requirements are in addition to the current requirements governing the Employment Eligibility Verification Form (Form I-9) procedures. The E-Verify process must be done in a nondiscriminatory manner and, in the case of new hires, only after the individual has accepted an offer of employment and completed the Form I-9.
The University is also required to post the Right to Work poster and the E-Verify Notice, which informs employees and applicants of their rights and responsibilities under the program. These notices may be downloaded from the USCIS E-Verify website once the location signs the Memorandum of Understanding (MOU). Once downloaded, the notices should be posted on location HR bulletin boards and on HR websites where they can be readily seen by employees and applicants.
